" A little bit of good news for those in Jail for Chelsea "

Please pass this on to any of your mates or people you know who have been sentenced to Jail and don't know about the below, it could reduce sentences significantly.


Good News to share - Anyone who is serving a sentence of between 4 months and 4 years is eligible for home detention curfew.

The maximum length of time a prisoner can spend on HDC prior to being released on license is 135 days.

When they arrived in prison they would have been provided with a slip of paper entitled sentence caluclation.

It will have this information on it.


HDC dd/mm/yyyy

LED dd/mm/yyyy

SED dd/mm/yyyy

The first step would be getting them to sign the prison law forms and then writing to the sentence planning department and finding out when their HDC eligibilty date is.

For example if someone was given a sentence of 6 months they will elgible for HDC after 45 days. 12 months would be 90 days.

The prison would then undertake a risk assessment which we would recived a copy.

Certain prisoners are ‘deemed unsuitable’ and if this is the situation they must be informed upon arrival and this is subjct to appeal. It is unlikely to apply to any of the Cardiff cases. Offenes which are caught by this provison are homicide, sexual offencs and possession of an offensive weapon.

If any of them are serving less than 12 months (and more than three months) then are eligible for the ‘presumptive HDC scheme provided they have not been convicted of an excluded offence (all violent offences) within years of the date of the current offence. This will be open to all of the clients who are of good character.

However they can all apply for standard HDC. They will be given a form HDC9 which sets out their eligibility. They must complete HDC 2 giving the details of the proposed address 10 weeks prior to the HDC eligibility date. A risk assessment will then be completed by the prison.

The normal curfew will be of 12 hours (7pm – 7am). This can be varied to 9 hours if special circumstances apply.

That's great news Vince and hopefully common sense and justice will prevail, these lads involved have been scarificial lambs for a far deeper agenda than we are being told. :old:

Demaids Solicitors in Cardiff (02920 235575) specialise in HDC Release. Ring them up and they will take the prisoners details and then arrange to visit the Prisoner and start the legal process for HDC release.

The probation service will visit the home of the prisoner to check if the home is suitable for Home Detention (Tag)they will then submit a report to the Holding prison and along with Demaids legal report, the Prison will make a decision on any early release.

I dont 100% know if Demaids work outside the South Wales area but i am sure they will advise on another Solicitor closer to the Holding prison.
