Nearly 5 years later:
The club has lost £millions due to losing court cases after court case and fines and interest.
Vincent Tan is suing Willie McKay, who was involved in the transfer of Emiliano Sala from FC Nantes.
The problem is Will McKay is a bankrupt.
viewtopic.php?f=2&t=204226Plus we all knew Mckay was Emiliano Sala agent, very good friend of Neil Warnock’s and had his two sons playing for Cardiff City’s U21’s at the time of the deal.
The legal action against Mr McKay is for the release of documents and data, which the club believes, will prove beyond doubt that he was the agent for the Sala transfer and strengthen their ongoing legal proceedings against Nantes.

We have now paid what we owed and the added legal fees - so I am all for Tan trying to get something out of Nantes as to date it has all been at our expense - fingers crossed he succeeds.

This is not about the money as McKay has none, this is about unearthing evidence and making a connection between McCay and Nantes. The bigger picture is to prove that Nantes were employing unscrupulous characters like McKay and are liable for Sala's death. I think the club will be vindicated in the long run for taking legal action. They've already won a decent sum out of their insurance company.

Wouldn't he have had liability insurance at that time ?
Plus its the right thing to do, these skimmers take, take, take. Its about time football clubs got their own back

Where has this originated from? Tried searching the web, but can’t see anything. If he’s suing him for access to paperwork that’s one thing and good on him if he is. If he’s suing him for money that’s different.

Just some points needing clarification here
1. The details of this were conveyed to the Supporters Trust earlier today on an exclusive basis and was conveyed to Trust members this afternoon. You don`t mention this in your post.
2. The action is for the release of documents and data (as you repeat above from our report) so Willie McKay`s personal financial status is irrelevant. He is not being sued for cash.
3. Actually, Willie McKay is no longer bankrupt as he got his discharge in August this year.
4. A lot of people , including CCFC, are convinced that Willie McKay was FC Nantes` agent. However , in their defence to CCFC`s claim against them filed at the very end of November(see the Trust update report on the legal action posted by us earlier this month) Nantes specifically claim that he was not their agent. This action against McKay could only follow on after that to produce the papers and other data to disprove their defence.
Hopefully , this clarifies some points which might otherwise be misconstrued by readers of the board.

I agree that the insurance, with the benefit of hindsight, possibly could have been a source of better cover. However, it is simply not true to say the the money recovered from the settlement with the brokers was a "pittance" as it was very substantial.

It seems that Jamie misunderstands how legal claims and cases work. A recovery from the current actions would be a huge boost for the CCFC finances

It would have cost them more in court….so they pay little ….less than the lawyers and court costs .
For example This is a very common ploy employees use against employers. When their contract is terminated and whatever fair settlement the employer offers ….they still go legal ….over what they are offered …!the court case say May cost £40,000 ….so they pay 10,000 . They are happy and the employee is happy.

If the documents and data recovered from McKay show him to be Nantes` agent then it blows a huge hole in their defence of the claim made against them by CCFC.
I personally don`t expect the legal case to go all the way to trial later in 2024 , but do expect Nantes to agree to a very substantial out of court settlement in favour of CCFC.

Excellent, if they can secure the paperwork. It seems CCFC have patiently and increasingly been painting Nantes into a corner they won’t be able to get out of. I’ve always believed they had a case under the Law of Agency to tie the Mckays and Nantes sufficiently and think I’ve said it in other posts some time ago. McKay’s involvement in the flight has been proved in the criminal courts. McKay has confirmed in print he and his son were the sole agents of Nantes for selling ES in the UK.

Not sure where you get the idea that the brokers paid less than the lawyers and court costs. The amount they paid was very substantial and has made a big difference to the club`s Profitability and Sustainability position.

I said we would lose case after case regarding player etc, sadly I was totally proved right despite others saying we would not and it was worth while, we lost £millions and embarrassed our clubs proud name beyond.
Let’s see what happens yet again.

I really don’t understand why, now that we have paid Nantes, any Cardiff fans wouldn’t want Tan to pursue all avenues to recover at least some of those millions?? Unless there is a hidden agenda or they know something that is not in the public domain.
This case is about “disclosure” of documents that may SIGNIFICANTLY strengthen the bigger case against Nantes. If they do then, as others have said, the case may not go to courts but could well result in a multi million pound settlement.
I expect our owners to safeguard the finances of the club and, at the moment, it appears that is exactly what Tan is doing in this instance.

The other thing that surprises me mate is why also any player would want to be represented by this guy? ES said he felt like a piece of meat in how he was being treated by McKay and also Nantes. Again, no sentiment in football by the guy is proven bad news but money talks I guess. I also wonder if McKay has anything on some powerful football people as I don't understand how he'd get his operating license again and we all know how bent FIFA are.
I'm no VT fan only in so much as I think his time here as owner expired a while back and it's obvious that MD is pulling the strings now but I applaud the fact that he has gone after McKay and Nantes on this, for financial and reputational reasons, as the more that comes out, the worse it gets for the instigators. I'm also mindful not to forget that a young man in his prime lost his life through the actions of an agent who defines the term 'cowboy'. And for some strange reason, is allowed to operate again. Unbelievable.
