I'm guessing it's more likely to be a cock up by the club. Someone forgetting to renew.

Does that mean somoene could produce merchandise with 'Cardiff City Football Club' and 'Cardiff City FC' without an issue?

Interesting, how much to buy them

Owners of expired trademarks have 6 months after expiration to renew.

All very interesting.

Re: BARNETT- ELAPSED TRADEMARK...NO!

Thu Feb 21, 2013 11:06 pm

Again, Vincent's disciple, I have already stated that there are still ACTIVELY REGISTERED trademarks. My question was, are the words of that trademark tied to the badge presented on the very link on that page?

Why am I asking? Well, you may have noticed our badge this year is red with a dragon on it. Therefore, that registered trademark you just presented there may have no legal correspondence with the current badge that our club uses.

Ever thought the reason Tan changed the badge was to get out of this trademark? I suggest you do some research on the history of Red Bull Leipzig and you'll find out.

Wikipedia definition (not gospel I know)

A trademark is typically a name, word, phrase, logo, symbol, design, image, or a combination of these elements

Now if that trademark is formed legally on the basis of a combination of elements which appears the case due to the fact there is an image of the old badge ON THE PAGE YOU PRESENTED then there is a strong chance that it could be argued that this trademark is void.

The old badge is there, is it not?

Also, do you see a trademark registered with the new badge and Cardiff City FC as a combination of elements? No, Craig, you do not.

Mate, there is no point in arguing. Some of these people were adamant the rebrand was a myth, a rumour, scaremongering after the playoff defeat but now have come to realise that is not the case. Let them claim what they want, if these changes are made I will not be happy that I was right, I will be sad that the club we all love in our own way has been picked apart.

This is taken from a trademark search on the very site you linked. I think you'll see that I am right and that the trademark has the status of EXPIRED. It was registered in 02 and has now lapsed with no renewal as you can see there.

I alerted the club about this matter months ago. As someone involved in TM registrations I considered the situation quite shocking - and I am hoping that it doesn't indicate that Tan is looking to change the name of the club.

I informed the club of what could have been a 'cock-up' months ago. They acknowledge my email but have neither thanked me nor responded to me in full - and I am getting blanked about the possibility of taking over the Bluebird TM.

I guarantee they won't stay expired for long after this.

TBG, having been a reader of the other board for years I know you are a truthful poster with a genuine concern for the club. I knew that you wouldn't post on such an issue if there was no credibility of it.

My only guess is no trademark has been registered because they are waiting on a final badge. They may have purposely let the old one lapse as its a combination of elements and therefore will not register a new trademark until the compromise on a new badge design in the summer. That is also a plausible argument. However, given the current antics of the club it will come as no surprise if a name change is the reason. I hope the name don't change but then its happened to other clubs.

Here's hoping they are waiting on the compromised badge in the summer to register a new trademark. Maybe they haven't registered this year due to it not being viable as its only a one year thing. That could be the reason and I hope its the reason but until a trademark is registered with the new badge and our name then there will always be doubt about the future of the clubs name.

I think that we may be confusing several issues here. The new 'beer mat' badge has not been registered as a trade mark but that was not my point. It is possible that the club may have considered that the badge was temporary and decided against registering it (although I would have done anyway).
The fact is that the word TM 'Cardiff City Football Club' expired last year and that I alerted the club regarding that fact months ago. In my opinion (and I was responsible for my employer's TM portfolio for years) it was probably a huge oversight or a very bad lack of judgement - even if the TM was to be for one season only. By the way, the dragon used on the badge was from a clipart image available to use free of copyright. As such, the club couldn't register the dragon on its own as a TM as it wasn't their design.

Fair enough - and good for you - but there's a story in it now. They'll want to make that go away for a start.

No. Non-registered TM still afford the owner some protection. It's inadvisable to let 'live' TMs expire, however.

Cardiff City AFC Bluebirds is still registered. Whether we are covered under this I do not know and someone with more background in this regards may be able to help us out.

However, 'Cardiff City FC and Cardiff City Football Club have expired. I don't know the implications for this but why have they been allowed to expire?

I would say that 'Cardiff City AFC Bluebirds' doesn't offer protection to the lapsed mark 'Cardiff City Football Club'.
Not at all.

Or you could have just answered a simple f*cking question, instead I had to trawl your titangraph of an answer.

Anyway..it is quite alarming that "Cardiff city football club" has expired, but there are the other TM's in place. You have 6 months from expiry to renew anyway..plus I can't see why Tan would bother forking out for the Cardiff City Football Club sign/lights on the stadium only to change the name to KoyKarpFC

The stadium face will have to change Next season anyway. New crest next season and new players/shirts.

Hardly a big job.
