I've suggested before that the whole point of pursuing the case at every opportunity wasn't so much to win, but to go through the process so little bits and pieces of information become documented through the process of discovery in the various layers of courts.
If the club accepted any guilt in the process (and making a payment to Nantes could be perceived as an admission of liability) then the club has to pay directly and won't be able to lean on insurance.
We're getting towards the end part of that process now, with the Club tackling the insurance broker for failing to offer complete professional guidance in the area of expertise that they are paid for. I could see how this could lead in two directions - the broker argue that it wasn't their responsibility to advise as he wasn't a fully registered player, which returns us to the original argument, and this time the Club can point to how Welsh clubs are subjected to unfair regulation compared to others in the same league structure - God knows where that leads it might even mean action against the EPL or FAW for subjecting the club to regulation that puts them at a competitive disadvantage.
Alternatively, the insurance brokers themselves accept that they didn't advise correctly as the club was a registered player (as outlined by the three court cases). At this point, the fight goes back to the agent and the flight organisers. As the agent was acting on behalf of Nantes then it could eventually go back to them as well.
While I understand a lot of people struggle to get passed the very tragic human aspect of this situation, and so the they see the club's actions as unpalatable because of the emotive aspect of the situation, as someone else said, the club has a duty to its shareholders to correctly follow all possible paths to avoid paying a fee for a player that was never delivered safely.
Remember, at the bottom of all of this, we had arranged a business class flight for Emiliano.
He sadly never took that flight and Mackay, who was being paid to broker the deal by FC Nantes, arranged an illegal flight, with an unqualified pilot on an uncertified light aircraft.
The one thing I've said all along we should have done is make some payment related to Emiliano's salary as a charitable donation to a trust for his family so they don't have to suffer further pain in addition to losing a loved one as the legal battle between Cardiff, Nantes, Mackay and all the insurers was always going to drag on for many years in a complex case like this.
Not only would that have been the right thing to do, but it would have put the club in a much more positive light as far as the outside world sees us.

Great Post and have we not already set up a trust fund for the family even before this sad case hit the courts.?

Yes we have ... or certainly done something on those lines several years ago if stories are to be believed?

They did last time there was headlines on this subject... think was the anniversary and his mother was in the news regarding the trial as well so hence the club saying about trust fund . ... probably why there is nothing coming out now from his relatives.

ITS hard to know precisely what is what as a lot of disinformation comes out on this board... all can say the club put in place financial help for the family whether its enough we may never know as full details will probably never be divulged .

Thanks Allen, thought that was the case but as you say so much is put out that is shall we say inaccurate that important items about what good the club has done is lost in the anti Tan agenda.
Perhaps it should be put out more but I suppose then the club would be accused of using that to hide something else or maybe just maybe there is an agreement between club and family.

I agree in principle - but when people are throwing around phrases like "stain on the football community" in reference to the club, i'd say they have a right to highlight when it comes to the player's family they have acted with compassion and empathy.
Just look at the BBC comments every-time we play and some dickhead somewhere makes a comment like 'Disgrace of a club' with direct reference to Sala - regardless who we are playing. In fact, you don't have to go that far afield, just look at this board, half of our own fans use similar language, and probably have zero idea that the club have made sure Emiliano's family are looked after (I didn't know this until Allen pointed it out).

What I pointed out was posted on this board ... the club make very few references to what they've done but what they've said as Been quoted on more than one occasion.... on here.... dont care what people say there are elements that thrive on anything negative about club whether its true or not? the evidence is glaringly obvious on here well to most it is.

I feel sorry for his family who have to listen to this shite from different people, organisations bitching about a sum of money in comparison to a human life-Maggots all of them
