Question on employment law (FAO M4 Solicitor)

Fri Feb 08, 2013 8:10 pm

A mate of mine works in a shitty job, if they don't hit production targets by a Friday they are expected to work on until the targets are reached, for NO extra pay.

I'm not aware of the terms of his contract, but can the employer legally ask him to work extra hours for no financial gain or hours in lieu?

M4 solicitor, I'd love a response from you.

I'm not an employment law expert.

However I've got a good referral system in place with a specialist employment Firm. They normally give initial advice over the phone.

PM me or call for details if I can help

Depends if in contract, if piece work and if bonus earnt.
Also depends how long extra worked

Eg if they are paying him to work 40 hours per week, 8 hours a day. If he has a hour break each day he has only really worked 35hours so some naughty people would class he owed 5 hours. Best to speak with colleagues and then decide on a course of action but if it's a job anyone could do he would probably be better off looking elsewhere.

If it is an easy job the employer probably won't care what is said because they will eventually get rid of them and replace with someone else.
