SOME GOOD NEWS

Mon Dec 21, 2009 7:39 pm

I have been down the ground today, the pitch is rock hard, but from 8am this morning they have been working on the heating it will be all up and running by Midnight tonight. A few people are moaning as the Rugby refuses to contribute to the cost, but as much as I hate Rugby,I am on their side on this one as in my opinion we are the landlords.

Good news.

I suppose it depends on what is included in the contract.

If there is nothing in the agreement between the club and the rugby then maybe we'd be in our rights to charge them if ever they wanted to use it. Maybe they feel that it isnt for their benefit so why should they pay.

Its all down to the detail of the stadium agreement really.

Yeah, I understand that.

Basically there was NO agreement related to it to start off with, that seems clear, so the club asked the rugby lot to chip in. The rugby lot, refused, as seems to be their right, so the question is now... do the Blues have the right to use the undersoil heating or not. Surely this will be down to the stadium sharing contract, and depending on this wording we may be able to charge them to use it, and I'm not talking about just the maintenance or running cost, but a rental as well, whereby over time as they use it we will be able to claw back some of the 'investment'.

Tim, They will be charging them 25% for maintenance costs,as we own it and on their games 100% they pay all costs.I reckon its hard to work the last bit out.

Yes thats fair enough, the only questin is, does the undersoil heating count a ssomething that they should expect as part of their deal or an 'extra' if its an extra then we can charge them to use it.

My guess is we wont, and their argument would be that it is to be expected in a modern stadium and should be included as part of their standard stadium agreement charges.

All those solicitors involved in our board/major shareholding and they didnt think of getting this agreed beforehand, or included in the contract.

I think the Blues are well within their rights not to contribute. As it has been touched upon, as the landlord's it is our duty to make sure the facilities are all in decent shape. That's what the Blues pay the upkeep for!

Just glad it's finally done. However, we knew it was going to be a 'Siberian winter' so why these steps weren't taken in the Autumn I don't know!
