Embargo question.

Sorry if I've missed this but am I right in thinking that no matter what happens before the 11th August the embargo cannot be lifted before that date?

Although the club may have come to some arrangement with HMRC with regard to the repayment the fact that there is still a hearing on 11th means that only at that hearing will the winding up order be dismissed. Is it possible that if ALL the money outstanding has not been repaid by the 11th then the order will just be postponed again thus still leaving the embargo in place.

Are HMRC going to withdraw the application on 11th in view of the agreement or postpone it?

Even if we repay all the money to the HMRC, Charlton and Motherwell before 11th, will we still be under an embargo until the hearing itself or can the embargo be lifted beforehand?

I seem to remember the embargo being lifted in November without a hearing when the HMRC agreed to a 'payment schedule' which Ridsdale promptly broke.

However, I suspect there is some kind of payment schedule in place now which requires us to make payments before the 11 August. Providing we keep our word the HMRC will most likely request that the petition is withdrawn on that date and not before due to our recent 'form.' I would also imagine that both Motherwell and Charlton's broker will receive their monies around the same time, allowing for the embargo to be lifted.

It's not the HM tax that the embargo,is on for, and its not the accounts because they are in, it's only Charltons non payment that the embargo is on for :thumbup:

Thanks Tony. That still means however that whatever happens between now and 11th August the embargo will not be lifted before that date.

The embargo CAN be lifted before this date, the courtcase on the 11th is primarily with the HMRC, they can be satisfied with payments before this date but the court case will still go ahead as a formality. The embargo as im aware is currently in place due to the payments owed to Charlton and Motherwell.

That's true the HMRC could allow us to lift the embargo before the 11 August but IMO it depends on our compliance with the HMRC payment schedule. On the previous occasion last November they publically acknowledged that they were happy (remember the official website statement?) but I don't remember a similar thing this time.

I would imagine the Motherwell and Charlton monies are also still outstanding and will be paid around the 11 August allowing the embargo to be lifted.
