14B Banning orders made on a complaint
(1) An application for a banning order in respect of any person may be made by the chief officer of police for the area in which the person resides or appears to reside, if it appears to the officer that the condition in subsection (2) below is met.
(2) That condition is that the respondent has at any time caused or contributed to any violence or disorder in the United Kingdom or elsewhere.
(3) The application is to be made by complaint to a magistrates' court.
(4) If—
(a) it is proved on the application that the condition in subsection (2) above is met, and
(b) the court is satisfied that there are reasonable grounds to believe that making a banning order would help to prevent violence or disorder at or in connection with any regulated football matches,
the court must make a banning order in respect of the respondent.
Bear in mind that sub-section 14B2 says only that the person must have “contributed to” not have been convicted by a court of an offence of violence or disorder.
There are already many fans banned for reasons that fall short of the real reason why banning orders were first introduced in England and Wales. There also fans banned who deserve to be banned.
This section 14 b has been around since 2006 and its not widely known to the average man on the street, but using this secton 14 b the police can virtually ban anyone from football who has a previous criminal record even if it has absolutely nothing to do with football.
It is a civil case and very little evidence or proof is required for a 3 year ban to be issued (9 Leeds fans had them Monday...none had committed a football offence but the police decided that because they are regular fans and have in the past had trouble outside of football that they MAY become a risk so asked the judge to ban them.
If you breach the banning order it becomes a criminal offence and that clearly has implications.
The FSF are looking into this now and see it has a human rights issue and will be seeking more information to appeal against these banning orders...Liberty are also very concerned about this and have offered to assist the fans organisation with campaigns.
