Australia cancels visa for a second time leaving tennis star facing deportation

Novak Djokovic has had his Australian visa cancelled by the country’s immigration minister. This is the second time that the tennis star has had his visa revoked and his lawyers are expected to challenge the decision in the court, but as things stand the Serbian faces deportation from Australia.

Announcing his decision, Immigration minister Alex Hawke said: “Today I exercised my power under section 133C(3) of the Migration Act to cancel the visa held by Mr Novak Djokovic on health and good order grounds, on the basis that it was in the public interest to do so.”

The men’s world number one broke his silence over a number of accusations of breaking Covid protocol on Wednesday, and he conceded that he broke isolation and conducted an interview with French newspaper L’Equipe despite knowing that he was positive for the virus, such a transgression could result in up to five years in prison if proven that he lied about his positive test.

Chris 100% for me as well just deport him and a 3 year ban for falsely filling in his visa application. He reckons his agent filled it in, is he that thick? (no) unless a person who is physically or mentally disabled and unable to fill in the application, they are allowed to have someone to fill it in for them, the rules state that you have to fill it in yourselves. he is just trying to cheat his way in :banghead:

Loved your response Crayfish, spot on ! I know it's off topic a bit but Howard Stern's childish name calling could be lifted from so many American film scripts nowadays. As soon as I hear dialogue consisting primarily of grown men calling each other such inanities as douchebag, numbnuts, f***wit and the like, it's a case of "get me out of here" !

Back on topic, I hope Djokavic gets booted out of Australia because he's knowingly lied to the authorities and has an air of untouchability that until know has been unchallenged.

He's lied on his visa application and not followed the rules after testing positive last month so its a no brained for me.

If any appeal doesn't succeed then he may not be able to apy for another visa for 3 years, so he may never play in Australia again.

Makes sense to everyone, unless you're trying to enter the UK, then anyone can come, visa or not.

If the Aussie Government hadn't quietly bent their rules, (when the COVID situation was far more worrying than it is today) for ultra wealthy then fair enough.

But they did. And unfortunatley for them the Internet never forgets.

Politcal posturing and hypocrisy at the highest levels.

That’s a weak argument imo. Because the Australian government bent the rules for Person A they should break the rules for Person B?

I’m not sure what the entry restrictions were in Australia back in May 2021 and the article doesn’t highlight them either. The article doesn’t even say whether these celebrities were breaking the entry requirements, if they were you’d think it would be mentioned no?
Perhaps owning property in Australia, having a tax paying business, Australian ancestry, etc was enough to be allowed in and their wealth allowed them to legally exploit these loopholes.

Djokovic on the other hand doesn’t meet the requirements to be allowed entry into the country.

In fairness and on reflection you're probably right and to be honest i've neither the time or inclination to look I to it further so let's just assume you are.

I'm just fed up of governments of all nations being hypocritical prices and choosing which battles to take and which to let slide.

I'm just tired of all the obvious manipulation and the sneering arrogance of them all in thinking we don't notice how they change the rules whenever it suits their agenda.

I just read up a bit more on this.

People accusing Djokovic of lying to the Australian government are fairly wide of the mark.

Sounds more like either Tennis Australia acted without authority to grant him the exemption they did or the Victorian Government is using the situation to flex political muscle.

The judge in the first trial is directly quoted as saying:

"What more could this man have done? Here, a professor and an eminently qualified physician have produced and provided to the applicant a medical exemption. Further to that, that medical exemption and the basis on which it was given was separately given by a further independent expert specialist panel established by the Victorian state government and that document was in the hands of the delegate."


Someone up the thread suggested they hope he gets booted out because he knowingly lied to the authorities. With all due respect that's not actually true. If anything Djokovic himself has been very open with the Australian authorities.

  • He announced he had tested positive to the Australian Border Force, on his arrival as he was supposed to.
  • His positive PCR test was 18 days earlier so was fine to travel under Australian rules.

  • There was an error on his travel documents (completed by his team) that omitted a trip to Spain within 14 days - He confirmed/clarified this international travel with ABF on his immediate arrival - as he is supposed to.

Considering he has already had his exemption examined and signed off by two committees prior to all this. If he is deliberately lying to the authorities, then he's pretty bad at it - so let's maybe hold fire and get all the facts before hoping he gets booted out.

I mean if we take a minute to actually think about what is being advocated.

If he gets deported he is banned from Australia for 5 years so it is effectively stating that he can never enter the Australian Open ever again. We are talking about the greatest player to have ever graced the sport. He has more masters wins, more masters finals, and is the only player in history to have the golden masters series. He also has more grand slams than any other player in history.

Aside from being an excellent tennis player apparently he is a good person as well.

He set up the Novak Djokovic Foundation in 2007 which has so far built 43 schools and supported almost 20,800 children and a thousand families and has raised a ton of money for various charities over the years including €1 million for the purchase of ventilators and medical equipment to support hospitals and other medical institutions during COVID.

Yet, people want him kicked out effectively barring him from ever playing tennis in Australia again just because someone on his team filed one part of the paperwork incorrectly even though Djokovic himself declared the mistake and ammended it on arrival.

Seems a bit harsh to me when you put it like that.

(Actually, I just saw who made the boot 'em out comment. Without wanting to reveal his secret identity ole' Moody has a history of Tyranting in one of the highest offices in Cardiff at the time no less so that doesn't surprise me. ;) )

Lawyers from both sides have made their cases to judges at the Federal Court of Australia

The emergency hearing, which is taking place online, has now adjourned with a verdict expected later on Sunday

Djokovic faces deportation and a three-year ban on obtaining a new visa if he loses the appeal

But if he is successful, he will be free to defend his Australian Open title on Monday

Immigration Minister Alex Hawke cancelled his visa on Friday, saying his presence in the country risked fanning anti-vaccine sentiment

The Serbian player's lawyers, however, argue that deporting him would stoke anti-vaccine views and protests
