SALA CIVIL CASE HAS STARTED

Sala civil case starts

Cardiff City and Nantes were in court yesterday for the pre-trial hearing over the civil case pertaining to the Bluebirds seeking compensation of around 110m euros.

Cardiff vowed to take separate legal action against Nantes after the Swiss Federal Tribunal decided the Court of Arbitration in Sport did not have jurisdiction to deal with the Bluebirds' damages claim. Cardiff were hit with a transfer embargo by FIFA after their initial refusal to pay Nantes the first instalment of the fee for Sala. They have now paid that sum, around £7m, and FIFA sanctions were lifted. They are still in negotiations to have the EFL's sanctions lifted in order to allow them to pay fees for players.

The two sides were scheduled to begin the hearing at Nantes commercial court early this afternoon, and it is believed the dispute could last anywhere from 12 to 18 months. Today's hearing will discuss the positions of the two parties and set a procedural timetable.

As I read it, this was a hearing to decide if and/or how it might go forward...

We await a decision on this but the full case, assuming it goes ahead, is likely to last uo to 18 months...

Is this just new to me?

Nantes are also in dispute with Bordeaux as the latter are waiting on a 6/7 million euros from Nantes as there was a sell on clause when they sold him.

Cheers Chris, the hearing yesterday set the next significant date as January, so it indicates that the full case will now go ahead and the vast majority of these cases do anyway. I'm not sure that yesterday's hearing was an opportunity to throw the case out and it may transpire that it could still happen in January but very unlikely.

I don't understand where the 110m figure has come from?

I think it's something to do with losses from being relegated as ES goals would have kept us up.
( I do not know how that is worked out as he may not have scored any)

Highly unlikely that he wouldn't score any goal. It would only have taken two goals to turn a draw to a win and a loss to a draw. Then we would have stayed up.

But it is all very much based on supposition.

If I was the club I would have the stats for every striker bought in the Premier league during 10 years of January transfer windows. I doubt any would have scored less than two goals to the end of the season.

That ties in with what I understand to be the positive of this, i.e. that Wednesday's hearing was effectively to determine whether Vincent Tan (I'm loathe to say the club) has a case worthy of hearing...

It seems he does, although the outcome is far from being guaranteed :ayatollah:

Can a case actually be proven on a hypothetical goal ratio then?

I think with how it went down as well with his unfortunate death, other players we tried to sign were put off as didn’t want to be involved in the whole saga or be seen as his replacement

Sure that was said at the time by someone, could be wrong

It was and if I recall right, Jarrod Bowen (now West Ham) was one of them... :(

A civil case is based on balance of probability. As ES as 2nd top scorer to Mbappe in the French League at the time I suppose it’s reasonable to assume he’d get a couple here. Strangely, Sory Kaba is a good example of it.

Which is what should have happened in the first place. I think if Bordeaux hadn't had such a large sell on clause and Tan hadn't been such a stubborn man, there was scope to have agreed to split the difference at the very start and save a lot of cost not to say ill feeling and heartache
