The regulator for English football will now not give sporting sanctions for clubs - ruling out points deductions for breaching regulations on finances and respecting the desires of fans, the government has outlined



The regulator for English football will now not recommend sporting sanctions for clubs - ruling out points deductions for breaching regulations on finances and respecting the desires of fans, the government has outlined.

Sky News has compared the plans in an updated framework and model for the football regulator with the white paper published in February, that had called for sanctions to ensure "non-compliance is met with genuine consequences".

Ive been pondering this and I wonder whether a specific FIFA statute is behind it.

Under FIFA Statutes:

"FIFA remains strict that all member federations must be free of any government and judicial interference in their respective countries"

Lets consider a potential position:

a) The UK Government setup an Independant Football Regulator
b) That regulator suggested, that in the case of Wigan and Reading, points should be deducted
c) Those clubs appealed

This could be construed as government interference.

I don't like the decision but I think it is the right one given what the statutes say.

Now if the EFL applied a points deduction without any input from a government backed Football regulator - then that is a different thing. The EFL just needs to have the balls to apply the deduction and be opened to being sued by the respective clubs.

The important thing to note that this is at the wish of fans.

The majority of what the regulator does, is meet the fans wishes when possible.

Supporters trusts and groups all over the country were consulted.

Fans have often said that it's the fans who are punished when points deductions are placed.

That would be the case whatever sanctions are placed on a club.

It’s not a reason not to do it.

I just feel the whole setup should be scrapped and should start all over again. If a rich person wants to come in and spend millions on a club then they should be allowed to without any interference from a governing body who have over the years have spoilt the sport. Life would be a lot simple.

There’s certainly something to that Chris. Formula 1 is an example where this is the case. Formula 1 is boring to me but lots like it.

Problem is everyone else has to spend to keep up and then the club goes tits up. Clubs going out of business is not what we want.

That's when the fit and proper test needs to be properly enforced. Then it shouldnt happen.

But Ive said on here before. Scrap FFP. It only exists to keep the big clubs big and stop anyone from pushing their way in. Look how many hate Man City, Newcastle and Chelsea. We'd all love an absolute billionaire to do the same at City.

A point I have just realised, it is in the EFL and premier rules regarding FFP rules then that is nothing to do with the government, so no teams would be affected by the independent regulator,
Just another point if the regulator is indepenent then surely it has nothing to do with the government, and as a last resort the regulator can only recommend not enforce so unless the government makes a new law, which i think highly unlikely then it is all bull!

Just shows the big clubs are bigger than the game, the governing body can't police these clubs.

Trouble is FFP was brought in to safeguard clubs from this very thing,that is, reckless spending by owners under the protectorate of limited company rules and then walking away if it goes tits up if without fear of prosecution.

Now apply your logic to a football club (and by the way this is how it actually happens). You buy a football club,You make bad choices on managers,players etc. You run up massive debts, you can't pay the bills anymore. you can't pay the players any more, HMRC comes after you-You go bust-no more football club. FFP is there to try and stop this bad practice but as we know it doesn't always work. This is the hard bit---The owner walks away and because it's a limited company you can't touch him unless you can prove criminal negligence and when I last looked you couldn't prosecute anyone for bad business decisions.That's why so many companies are subsidiaries of other companies,you load all of your business debt into one company like the Glaziers are doing with Manu.In this particular instance though they've played a blinder.On a much smaller scale the same could be said about Vincent Tan.

Very harsh on them, but tough luck that boat has sailed life goes on, like us with Sala, we would have stayed up if they didn't put him on that plane, but shut happens.
