That guy is the owner of Yeovil town that Daya is arguing with.

This is a criminal prosecution. It's the Police that are taking Day to court. They would not do that unless they have a lot of evidence against Day.

He did not appear, it seems that he was not notified and the court has suspended the case till he gets notified, according to his media page as below.
[Thank you for all the messages of support today. Just to update you there is NO hearing tomorrow. I spoke with the court and its cancelled due to 4 different factors, there also as claimed any police involvement. Hellier Remains on police bail despite his tactics to evade the law]

Day is a compulsive liar as some of us have witnessed with him. Did he appear today or not.
