Had A Bumb in the Car

Wed Feb 03, 2010 8:11 pm

On the 18th of December and give the other driver my details. I was at fault and went straight in the back of him but up untill now I havent heard a thing. Is there a sort of time limit to this or something? Hopefully the Fucker wont claim (doubt I'd be that lucky tho) :ayatollah:

Firstly, if you havent already done so, I would let your own insurers know. It is written into the policy wording of most insurance policies that all claims (or possible claims) should be reported within a reasonable period. "Reasonable Period" is often defined as 7 days or so.

If the insurers position hasnt been prejudiced they probably wont say anything. However if you wait and 3 months down the line the guy does put in a claim your insurer may turn around and say that their position was prejudiced - as they could not now send an engineer to view "New Damage".

In answer to your main points

a) If the guy is not claiming injury - He has 6 years to bring a claim
b) If the guy is claiming injury - then he has 3 years to claim - under the Limitation Act.

Most people dont wait that long. If they did my job would be a nightmare!!!

In reality, if no claim is made within say 6 months most insurers would just close the claim down and reinstate your NCB.

Best Wishes

Paul Keevil

Same happened to me, rammed the car in front straight up the arse end at a roundabout, now I have got a bit of previous for road rage, so i need to be careful. Anyway this little bloke get's out, couldn't have been any taller than 5' 5" he came runnin up to my car, banging on the window and shouted "I'm not happy" to which I replied "I can see that, you must grumpy" 8-)
