I tried sacking someone at work today and couldnt. This woman is signed off with viral infection for 4 weeks. I found out that she has a saturday job working in a shop. She is still workng on saturdays so i rang up personnel who advised me that i couldnt discipline her as she was within her rights to have another job and that the sicknote only covered her weekkday job.

She can not claim any kind of authorites payments such as SSP if she is on the sick from any employer!
Besides - as her full time employer surely you have the right to sack her for working elsewhere under false pretense.

Just like the government will claim back any family tax payments if incorrectly claimed!

I thought that true. However Personnel were adamant that i couldnt do anything. Thinking about it if you have 2 jobs-i of which requiresyou to be on your feet all day (chef) and an evening job that requiresyou to sit down (e.g call centre) then if you break your leg you cant do the day job but the evening job is doable.
