Former Cornish soldier loses bid for jury trial over Northern Ireland shooting

A former Cornish soldier facing prosecution over a shooting during Northern Ireland's troubles has lost a Supreme Court bid to have his trial heard by a jury.

Dennis Hutchings, 78, a former member of the Life Guards regiment, is due to stand trial in Belfast in relation to the fatal shooting of a man with learning difficulties.

John Pat Cunningham, 27, was killed in Co Armagh in June 1974 as he ran away from an Army patrol, which was commanded by Hutchings.

Prosecutors directed Hutchings' trial be heard by a judge alone after concluding that there was "a risk that the administration of justice might be impaired if the trial were to be conducted with a jury".

Hutchings, from Cawsand in Cornwall, appealed against the decision, but on Thursday the UK's highest court dismissed his case.

Giving the court's unanimous judgment in London, Lord Kerr ruled that it was "entirely unsurprising" prosecutors decided there could be a risk of a biased juror or jury.


The judge noted Hutchings' patrol had been involved in a "firefight" with members of the Provisional IRA (PIRA) two days before the fatal shooting.

Lord Kerr added: "That the soldiers who fired on Mr Cunningham suspected that he was a member of the PIRA seems inescapable."

Let's hope TC Blue gets nowhere near a jury. Nothing like making a decision before the facts come out.

These cases are getting typical of the attack on law/army for doing their jobs but getting prosecuted for it? Just had police dog handler equited on charges of using his dog as offensive weapon against a convicted murderer and other offenders! :roll:

Surely everyone has a right to a jury trial not have one man decide the guilt or innocence of the accused. Saying that Justice would not be served in case there is a biased jury or juror, is an assumption that the people dealing with this case have no right to make!

It's the hostility towards British soldiers being in Ireland that's the govening the process? Not once are the terrorists involved in such incidents are persued or blamed its purely British forces that are to blame according to locals! Total witch hunt against soldiers ordered into a place by politicians that they wasn't trained to deal with...

They're screaming for justice against British soldiers but what about the poor people who will never get justice against the scum that is paramilitary factions in n'ireland :evil:
